UPPER STRUCTURE AND CONSTRUCTION MACHINE HAVING THE SAME

<P>PROBLEM TO BE SOLVED: To provide an upper structure enabling a tank capacity to be secured while the height of a passage is reduced and to provide a construction machine having the upper structure. Ž<P>SOLUTION: This upper structure includes: a slewing frame 15; a boom foot pin 23 which is attached to the front part of the slewing frame 15 for liftably mounting a working attachment 6; an engine 17 mounted on the slewing frame 15 at the rear of the boom foot pin 23; a cab 18 mounted on the side of the boom foot pin 23; and a fuel tank 19 and a hydraulic tank 20 mounted, parallel to each other in the longitudinal direction, on the slewing frame 15 on the opposite side of the cab 18 with respect to the boom foot pin 23. A recess 40 for forming the passage R2 having a portion extending in a back and forth direction on the fuel tank 19 and the hydraulic tank 20 and a portion extending from the rear of that portion to a position between the engine 17 and the boom foot pin 23 is provided on the upper surface of the upper structure 3.
