PROBLEM TO BE SOLVED: To provide a stapler having a binding staple identification function which improves binding work efficiency by preventing a binding error attributable to the loading of a wrong type of binding staple thereinto. SOLUTION: The stapler 1 drives a binding staple loaded in a magazine 2 into sheets of paper to be bound, thereby binding the sheets of paper, wherein an outer surface of a synthetic resin body portion 10 of the stapler 1 is provided with a recessed groove (a fitting portion for checking the binding staple) having the same shape and size which match the shape and size of the binding staple. This allows a user to apply the binding staple to the recessed groove for insert-fitting to thereby easily check whether the binding staple of interest is a type compatible with the stapler 1.
