PROBLEM TO BE SOLVED: To provide a battery case and a battery pack in which an increase of an inner pressure of a battery can be prevented. SOLUTION: The battery case 2 houses a battery 1 of which the volume can be changed according to a variation of an inner pressure, and a pushing pressure to a thin type battery by at least either an upper surface portion 22a and a bottom surface portion 21a becomes smaller toward a pressure releasing portion 17, at least when an inner pressure of a battery external case rises.
