PROBLEM TO BE SOLVED: To provide a surface emitting laser capable of oscillating in single lateral mode with higher output, compared to a conventional surface emitting laser. SOLUTION: The surface emitting laser that oscillates at a wavelengthλincludes an upper reflector, a lower reflector, an active layer, and a spacer layer. The spacer layer is a laminated structure that includes a first semiconductor layer having a composition of Al<SB>X</SB>Ga<SB>1-X</SB>As (1≥x>0) and a second semiconductor layer having a composition of Al<SB>y</SB>Ga<SB>1-y</SB>As (1>y>0 and x>y).
