PROBLEM TO BE SOLVED: To provide an insulation case for a secondary battery capable of preventing free play of an electrode assembly and enhancing reliability and safety of the secondary battery; and to provide the secondary battery. SOLUTION: The insulation case 40 for the secondary battery preventing the free play of the electrode assembly 10 housed in a can 20 of the secondary battery includes a square body part 44; and a supporting part 45 projecting in the direction of an opening part of the can 20 along the edge of the body part 44, and an angle between the supporting part 45 and the body part 44 is an obtuse angle. Since the supporting part 45 and the body part 44 of the insulating case 40 are not vertical, and the angle between the supporting part 45 and the body part 44 is the obtuse angle, a gap is not formed between the inside wall and the supporting part 45 of the can 20 of the secondary battery, and the free play of the insulating case 40 and the electrode assembly 10 can be prevented.
