The assistant (1) has a lane detection device (3) that detects deviation of a vehicle from a traffic lane. A warning device is provided for warning a driver based on the deviation. An activity device (6) determines a driver activity from temporal characteristics of position of a control element e.g. steering wheel. The warning device warns the driver based on the deviation of the vehicle and the driver activity. An independent claim is also included for a method for warning a driver of a vehicle.
