An optical disc discriminating method and apparatus are provided to cope with the new optical recording media rapidly and improve the reliability of the optical disc discrimination by minimizing the influence of the speed of the actuator different depending on the optical disk drive. An optical disc discriminating method includes a step for producing a first optical disk discrimination reference time based on the speed of an actuator and a first optical disk discrimination reference distance and a second optical disk discrimination reference time based on the speed of the actuator and a second optical disk discrimination reference distance(S18), and a step for determining the type of the optical disc based on the calculated first and second optical disc discrimination reference time(S22~S24).
