PROBLEM TO BE SOLVED: To provide a data embedding apparatus which encodes information to be embedded so as to reduce the effect exerted upon encoding efficiency without increasing a data amount as a whole.

SOLUTION: This data embedding apparatus for outputting encoded data resulting from embedding second data into first data and encoding the data comprises: a selection means for selecting a prediction scheme for calculating a predictive value for data to be processed in the first data on the basis of the second data; a prediction means for calculating the predictive value of the data to be processed in accordance with the prediction scheme selected by the selection means; a differential calculation means for calculating a prediction error of the data to be processed by using the predictive value; and a prediction error operating means for outputting the encoded data, wherein the prediction means comprises a "0" embedding prediction means which performs prediction when a bit value of the second data is "0", a "1" embedding prediction means which performs prediction when the bit value of the second data is "2", and an embedding end prediction means which performs prediction when the second data are completely embedded.
