An RTP(Real time Transport Protocol) transmission unit(114) transmits the encoded blocks to a data receiving apparatus. An encoder(111) acquires a data size of the transmission data at every certain time unit. A packet-size determining unit(116) determines a packet size of each data packet generated by the packetizing unit based on the data size acquired by the encoder at every certain time.
