An apparatus and a method for scheduling a packet flow in a packet switching network are provided to reduce a maximum delay value and thus improve QoS(Quality of Service) by generating a null packet in an empty queue and providing it. A receiving unit(720) receives a packet flow. A controller(730) receives the packet flow from the receiving unit, processes an empty queue of each packet flow, and provides a service with respect to the processed packet flow. The controller determines whether there is an empty queue, and when there is an empty queue, the controller generates a null packet in the empty queue.
