Provided are a direct oxidation fuel cell which can use methanol or dimethyl ether as fuel without reforming it into hydrogen, and a method for operating the direct oxidation fuel cell. The direct oxidation fuel cell is provided with at least one unit cell, and the unit cell comprises an anode, a cathode, a hydrogen ion conductive polymer electrolyte membrane inserted between the anode and the cathode, an anode-side separator having a channel for supplying or discharging fuel to the anode, and a cathode-side separator having a gas channel for supplying or discharging an oxidizing agent gas to the cathode, wherein the anode comprises a catalyst layer in contact with the polymer electrolyte membrane, and a diffuse layer. The diffuse layer comprises a porous composite layer(1) comprising a water repellent bonding material and an electrically conductive material; a first conductive porous base(2) which is arranged on the anode-side separator of the porous composite layer; and a second conductive porous base(3) which is arranged on the catalyst layer side of the porous composite layer.
