PROBLEM TO BE SOLVED: To provide a highly efficient and small optical element and an optical modulator or the like having the optical element. SOLUTION: The optical element has: a transmission path for guiding light made incident from an incidence edge to an emitting edge; a photonic crystal part which gives predetermined phase modulation to the light and an energy giving part which gives energy to the photonic crystal part so as to control the phase modulation by varying a refractive index of the photonic crystal part and wherein, the photonic crystal part is formed on or under the transmission path.
