A facsimile device having a response function and an operating method thereof are provided to be prevent entering in a facsimile mode although voice data having the same frequency as a CNG(Calling tone) signal exist in received voice data. A sensing unit(120) senses data having a predetermined frequency among received data. A checking unit(130) checks whether a facsimile protocol exists among data received after the data are sensed. A function performing unit(140) receives facsimile data corresponding to the facsimile protocol in response to the checked result.
