PROBLEM TO BE SOLVED: To provide a device and a method for generating electronic watermark embedded image data in which a watermark image can not be recognized during reproduction of an image, however, the electronic watermark can be recognized when the reproduction is stopped. SOLUTION: The electronic watermark data are set and superposed so as to make an integration amount of a source image over a plurality of frames and that of an electronic watermark superposition image to coincide with each other. For example, electronic watermark superposition data h(t) are generated by a set of an addition priority sequence and a subtraction adjustment sequence or a set of a subtraction priority sequence and an addition adjustment sequence. By this constitution, the image data, in which the watermark image can not be recognized during reproduction of the image, however, the electronic watermark can be recognized when the reproduction is stopped, can be generated on the basis of the law of Block that a plurality of images displayed during a period shorter than a fixed period of time can not be separated when a fixed number of images is displayed within a fixed period of time.
