<P>PROBLEM TO BE SOLVED: To provide a negative electrode capable of reducing stress due to expansion and constriction caused by charge and discharge of a negative electrode active material layer to improve a cycle characteristic; and to provide a battery using it. <P>SOLUTION: The negative electrode active material layer 12 contains at least one kind among a group comprising a single body, an alloy and a compound of an element, for instance, Si or Ge capable of forming the alloy with Li. An intermediate layer 13 containing a material having superelasticity or a shape-memory effect is formed between a negative electrode collector 11 and the active material layer 12.
