PURPOSE: A nonaqueous electrolyte battery is provided, to prevent a separator from breaking layers in case of the increase of internal temperature due to temperature increase or overcharge, thereby improving the stability of a battery. CONSTITUTION: The nonaqueous electrolyte battery comprises a cathode, an anode, a nonaqueous electrolyte and a separator, wherein the cathode active material contains lithium manganate, and the separator has a shut down temperature of 162 deg.C or less and an area contraction ratio of 15 % or less at 120 deg.C. Also the nonaqueous electrolyte battery comprises a cathode, an anode, a nonaqueous electrolyte and a separator, wherein the cathode active material contains lithium manganate, and the separator has a shut down temperature of 162 deg.C or less and a difference between a layer breaking temperature and a shut down temperature of 20 deg.C or more when the temperature is increased with a rate of 15 deg.C/min (a layer breaking temperature > a shut down temperature).
