PURPOSE: A tracking error detection device and a tracking error detection method of an optical disk device are provided to have a cut-off frequency which is higher than a frequency having -10dB spectrum of a modulation code recorded on an optical disk and is lower than a frequency having -5dB spectrum, and to smooth an output of a phase comparator, thereby detecting a tracking error for the optical disk. CONSTITUTION: A detection portion(12) detects a reflected light formed on an optical disk with at least two detectors. A phase comparator(20) detects a phase difference between outputs of at least the two detectors. Low pass filters(22a,22b) have a cut-off frequency which is higher than a frequency having -10dB spectrum of a modulation code recorded on the optical disk and is lower than a frequency having -5dB spectrum, and smooth the outputs of the phase comparator(20).
