PROBLEM TO BE SOLVED: To provide an encrypting apparatus, a program, and a recording medium for carrying out encrypting processing without having to detect the head of a payload portion, when a packet is encrypted.

SOLUTION: The encrypting apparatus includes an encrypted transport stream packet generating means for generating an encrypted transport stream packet by encrypting a specified portion of data set at a payload portion in a plurality of transport stream packets as stipulated in MPEG 2. In the encrypted transport stream packet generating means, the head of data which are encrypted from among data set at the payload portion in the transport stream packet is decided on the basis of the last portion of the transport stream packet set as a reference.
