PROBLEM TO BE SOLVED: To provide an AV data recording and reproducing apparatus and method in which an MPEG transport stream for special reproduction is easily generated. SOLUTION: The AV data recording and reproducing apparatus has a recording part for recording video data on the recording medium as MPEG data containing a PES header and a special reproducing part for reproducing the MPEG data while changing reproduction timing, a stuffing data region which is an empty data region is included in the PES header and in the special reproduction part, the stuffing data region is utilized to insert information for controlling the changed reproduction timing into the PES header without changing the size of the PES header.
