PURPOSE: A folding armrest and a seat apparatus having the folding armrest are provided to make various design of seats, turn the armrest easily and safely, and make a person to be seated on the seat feel comfortable. CONSTITUTION: A folding armrest and a seat apparatus having the folding armrest includes an arm frame(10) turning among a using position for use of the armrest, a passing-through position spread from the using position, and a withdrawal position folded from the using position; a hinge arm(20) rotatably supporting one end of the arm frame and having a first contact portion(23b) corresponding to the using position, a second contact portion(23d) corresponding to the passing-through position, and a third contact portion(23a) corresponding to the withdrawal position; a cam(30) engaging with the first contact portion at the using position to maintain the arm frame at the using position; a support frame(40) hinge-supporting the hinge arm and the cam; and a cam spring(50) disposed between the cam and the support frame to elastically support the cam. The cam turns by the second contact portion when the arm frame turns between the using position and the passing-through position, and turns by the first contact portion when the arm frame turns from the passing-through position to the withdrawal position. Thus, the arm frame is maintained at the withdrawal position. The support frame is fixed to a seat frame.
