PROBLEM TO BE SOLVED: To provide a rock breaking device capable of reducing time, cost, and noise of cut work by causing a crack on the surface side of a rock-bed and a cut construction method using the device. SOLUTION: An advance and retraction path (dashed line in Fig. 1) of a movable piece 21 is constituted in a condition in which a tip part of the movable piece 21 is directed toward a surface of a rock-bed to form an acute angle with the longitudinal direction X of a main body 1, namely, the longitudinal direction of a digging hole 7. For this reason, when a piston part 41 of a hydraulic jack 4 is expanded, the tip part of the movable piece 21 moves toward the surface of the rock-bed, and a crack CR propagates from a side part of the digging hole 7 toward the surface of the rock-bed. A surface part of the rock-bed around the digging hole 7 can be easily crushed by forming the crack CR going toward the surface of the rock-bed around the digging hole 7 in advance in this way.
