PROBLEM TO BE SOLVED: To provide a microlens substrate, which prevents fluctuation of birefringence due to temperature rise and has satisfactory optical characteristics, and an optical element utilizing it. SOLUTION: A microlens substrate comprises a first transparent substrate 1, on which recessing shapes are formed and a second transparent substrate 2 stuck together via a sealing resin 3. A transparent liquid 4, having a refractive index higher than that of the first transparent substrate 1, is filled in a gap between the first transparent substrate 1 and the second transparent substrate 2 surrounded by the sealing resin 3. The transparent liquid 4 functions as a microlens with projecting shapes. The sealing resin 3 is elastic resin and is preferably silicone resin.
