PROBLEM TO BE SOLVED: To suppress secondary multiplex jitters to be less by setting an interleaving pattern repeating the order of the time divisional multiplex of a packet at a prescribed period and generating a secondary multiplex stream. SOLUTION: In the setting processing of the bit rate of respective primary multiplex streams by a control part 6, the control part 6 sets a rate allocation period to time length equivalent to the integral/times of the transport packet, based on the bit rate of the generated secondary multiplex stream. The allocation period is the setting period of the bit rate of the respective primary multiplex streams supplied to a secondary multiplexer 3. The control part 6 changes the bit rate of the respective primary multiplex streams for each rate allocation period. Namely, the control part 6 fixes the bit rate of the primary multiplex streams in the rate allocation period and changes the bit rate of the primary multiplex streams in the boundary of the rate allocation period.
