PROBLEM TO BE SOLVED: To provide an apparatus and a method for arbitrating data transmission among devices having SMII standard in which a transfer error caused by data transfer delay is prevented by conquering the limit of a PCB pattern distance between an MAC chip to apply the SMII standard and a PHY chip. SOLUTION: In the apparatus for arbitrating data transmission among the devices having the SMII standard for arbitrating the transfer of data between mutually different first and second devices respectively corresponding to the PHY chip/MAC chip according to the SMII standard, at least one buffer means is provided for buffering the transfer data inputted from the first device while resynchronizing them prescribed times for the unit of a segment as many as a prescribed clock number, and outputting the data to the second device.
