<P>PROBLEM TO BE SOLVED: To provide a toner which is excellent in developability by controlling the dispersed state of wax in the vicinity of toner surface, and suppressing the fixing. Ž<P>SOLUTION: Regarding the electrostatic charge image developing toner at least comprising a binder resin, a colorant and a release agent and obtained by a water-based granulation process, the binder resin contains a modified polyester resin including a polyvinyl component in the polyester molecule, and in which the infrared absorption spectrum of the soluble component of ethyl acetate in the toner shows absorption peaks at least in a A wavelength (698±2 cm<SP>-1</SP>) and a B wavelength(828±2 cm<SP>-1</SP>), and the ratio C between the A wavelength/B wavelength satisfies inequality (1): 0.250≤C≤0.600...
