PURPOSE: A distributed contents transmitting system and a method thereof considering a network structure for preventing a bottle neck of a contents server are provided to transmit the contents through a corresponding transmission path. CONSTITUTION: A control server(10) establishes a transmission path based on network information, terminal information and content information. The control server controls the electrical transmission of the contents. A content server(20) transmits contents to the control server. A network information server(30) collects the network information and terminal information. The network information server transfers the network information and terminal information to the control server.
