PROBLEM TO BE SOLVED: To provide a device and method capable of removing surely foreign matter included in a food sample. SOLUTION: The device 6 for determining foreign matter contamination includes a laser light source device 7 for irradiating the food sample S with laser light having the first wavelength and laser light having the second wavelength, photodetectors 8a-8c for detecting each reflected light of a plurality of laser lights with which the food sample S is irradiated, and a foreign matter contamination determination means 11a for determining contamination of the foreign matter by calculating the intensity ratio between the intensity of reflected light having the first wavelength and the intensity of reflected light having the second wavelength detected by the photodetectors 8a-8c and comparing them each other.
