An apparatus and a method for preventing the illegal use of a lost portable terminal are provided to allow a finder to instantaneously recognize information about a loser by displaying the loss fact of the portable terminal and the contact number of the loser on the portable terminal, and to lock the functions of the portable terminal. A memory module(106) stores an electronic serial number of a portable terminal. A display module(104) outputs a contact number of a loser if a message about reporting the lost of the portable terminal is received from a base station. A controller(108) checks the contact number of the message and the setting of a locking function if the message is received from the base station. The controller outputs the contact number and sets functions of the portable terminal according to the setting of the locking function.
