An illegal copy preventive mobile communication terminal and an illegal copy preventive method thereof are provided to activate an illegal copy preventive function after a certain time elapses so as to prevent an illegal copying action, thus a finder who obtains a lost terminal is not possible to use the terminal. A controller(100) disables a terminal from being used, by setting a password locking function for illegal copy prevention after a certain time elapses. A timer unit(130) counts the elapsing time, and transmits the counted time to the controller(100). A memory unit(140) stores a program having algorithm which locks the terminal to disable the terminal from being used until an illegal copy preventive function is canceled, by activating the illegal copy preventive function after the certain time elapses.
