PROBLEM TO BE SOLVED: To provide an optical element which can control the polarization of a light which is emitted by a surface-emitting semiconductor laser and can be manufactured easily. SOLUTION: The optical element 100 includes the surface-emitting semiconductor laser 140, and a photodetecting element 120 which detects a part of a laser beam emitted from the surface-emitting semiconductor laser 140. The photodetecting element 120 is formed above the above surface-emitting semiconductor laser 140, and includes semiconductor layers 112, 113, and 114 each having one or a plurality of layers.
