PROBLEM TO BE SOLVED: To provide an imaging apparatus capable of more accurately determining whether it is a night scene.

SOLUTION: A digital camera 1A is equipped with a determining means for judging based on image data whether or not a photographic scene is a night-time scene. The determination means determines that the photographic scene is the night-time scene, when a high luminance part exists in a 1st part (AF area AR or the like) being the center part of a framing area FR and a low luminance part exists in a 2nd part (hatched part MR or the like) in the framing area.
