PROBLEM TO BE SOLVED: To provide a binding implement and a file equipped with the binding implement in which an opening/closing action which is not intended is hardly generated and there is no need to provide another member as an opening means. SOLUTION: In this binding implement, a base 2 fitted on a cover body 1 is constituted so that a cover part 21 fitted on the cover body 1, a supporting plate part 20 supporting the first binding elements 3 and 3 and the second binding elements 4 and 4, and a folding part 24 intervening between the side edge of the cover part 21 and the side edge of the supporting plate part 20 are formed with a plate material 2a, and under a closed condition, a force in the direction for making the first binding elements 3 and 3 and the second binding elements 4 and 4 to an opening condition is accumulated by elastic deformations of the folding part 24 and the cover part 21.
