PROBLEM TO BE SOLVED: To provide an information recording and reproducing device that shortens the recording process by avoiding recording on the area already recorded by detecting the area not recorded. SOLUTION: This configuration comprises a CPU 2 to drive the information recording device 1 according to a control software stored in a ROM 3, the ROM 3 which stores the device control software, an inside memory 4 to tentatively store the data to be written on an information recording medium 7 or read data or to store a recording medium control information, an I/F control 5 to control an interface (to transmit or receive the command and data) to upper devices, a read/write section 6 to control the data read and write on the information recording medium 7, the information recording medium 7 to write user's data, and the upper device 8 such as a personal computer to control the information recording device 2.
