Nucleic acid (A) that, after infection of a plant by a pathogen, generates and/or induces at least one transcript in plant leaves, at the latest 1 hr after infection is new. (A) is: (i) sequence (1) or (2) of 6832 or 8358 bp, reproduced in the specification; (ii) an intron-free sequence derived from (i) and encoding the same protein or peptide; (iii) a sequence that encodes a protein or peptide having any of 5 sequences (20, 29, 116, 6 or 25 amino acids (aa)); (iv) a sequence encoding a 116 aa protein (14); (v) a sequence at least 80% identical with (i)-(iv); (vi) a sequence that hybridizes to the antisense strand of (i)-(iv) or would do so but for the degeneracy of the genetic code; (vii) a derivative of (i)-(v) produced by substitution, addition, inversion and/or deletion of one or more bp; or (viii) a complement of (i)-(vii). Independent claims are also included for the following: (a) a fragment of (A) that either contains a promoter that is activated, in plant leaves, at the latest 1 hr after infection by pathogen or encodes a resistance peptide or protein; (b) construct containing (A) or its fragments; (c) transgenic plants containing (A) or its fragments, or the construct of (b); (d) tissue cultures containing cells or organs from the plants of (c); (e) shoots of the transgenic plants of (c); and (f) method for producing the plants of (c).
