PROBLEM TO BE SOLVED: To enhance mechanical strength while ensuring solvent cracking resistance, to improve resistance to electricity by direct electrification and to facilitate production. SOLUTION: The electrophotographic photoreceptor has a surface layer containing a resin comprising a polycarbonate or polyarylate having a substituent of the formula which can be condensed by heating in a side chain and having a weight average molecular weight of 5,000-20,000 before condensation. In the formula, R1 is optionally substituted alkyl or aryl, R2 is optionally substituted alkyl, (m) is an integer of >0 to 8 and (n) is an integer of 0-2.
