An apparatus and a method for preventing surge of a modem in a digital broadcast receiver are provided to minimize the damage of a device employing a modem due to surge caused by lightening by turning off tip and ring lines when the modem is not in use. A modem(10) converts data generated in a digital broadcast receiver into an analog signal and transmits a converted signal to a PSTN(Public Switched Telephone Network) through an RJ11 connection part(20). The RJ11 connecter(20) connects the PSTN and the modem(10). The first switching unit(30) switches ON/OFF of a tip line between the modem(10) and the RJ11 connecter(20). The second switching unit(40) switches ON/OFF of a ring line between the modem(10) and the RJ11 connecter(20). A controller(50) controls an ON/OFF operation of the modem(10) and an ON/OFF operation of the first and second switching units(30,40) according to whether the data is generated from the digital broadcast receiver.
