A surgical device for endoluminally or laparoscopically grasping and excising a tissue sample comprises a stapling device having a staple fastening assembly connected via one or more flexible force transmitters to a handle. The staple fastening assembly comprises a cartridge device containing curved open row(s) of staples and a knife. A curved anvil having a staple forming face is adapted to cooperate with the cartridge device. The anvil is movable with respect to the cartridge device along a longitudinal axis of the staple fastening assembly, which is curved about the axis. A lateral end of the anvil and a corresponding lateral end of the cartridge device are connected by a longitudinally extending lateral shaft so that a substantially C shaped frame is formed which defines a window for receiving the tissue and a lateral opening opposite the lateral shaft to provide lateral access to the window.
