PROBLEM TO BE SOLVED: To provide a recording and playback apparatus, which do not overlook a scene which is not in a memory, even if a viewer falls asleep during viewing, quickly search the scene, and can play back it, and to provide a method of controlling the same. SOLUTION: The recording and playback apparatus includes a viewing decision unit 3 which determines a first time point at which the viewer falls asleep and a second time point at which the viewer fully falls asleep based on image data photographed the viewer by a camera 2. When a control unit 8 receives decision results regarding to the first and the second time points from the viewing decision unit 3, it controls so as to make record the program from the first time point, and set a setting point for search regarding to the program in a temporary decision asleep period from the first time point to the second time point for the image. By the method, it can create a detailed chapter over the period, and record searching information together with the image data in a recording means such as a HDD 12, etc., thereby, the viewer can efficiently search the image.
