PROBLEM TO BE SOLVED: To improve focus detection accuracy by an imaging element provided with an imaging pixel and a focus detecting pixel. SOLUTION: The focus detecting pixel comprises a plurality of first focus detecting pixels mainly receiving one-side luminous flux out of a pair of luminous fluxes permeating an imaging optical system, and a plurality of second focus detecting pixels mainly receiving the other-side luminous flux out of the luminous fluxes permeating the imaging optical system; and, when it is assumed that regions subjected to photoelectric conversion by photoelectric conversion elements 3b and 4b within the luminous flux having permeated micro-lenses of the focus detecting pixels are photoelectric conversion regions, the positional relationship between the respective micro-lenses 3a and 4a of the focus detecting pixels and the photoelectric conversion regions is determined in accordance with the image height (h) on the light reception surface of the imaging element so that, on a pupil plane EP of the imaging optical system located at a predetermined distance PO from the micro-lenses, a plurality of photoelectric conversion region images obtained by projecting the photoelectric conversion regions of all the first focus detecting pixels on the pupil plane by the respective micro-lenses 3a overlap one another, and a plurality of photoelectric conversion region images obtained by projecting the photoelectric conversion regions of all the second focus detecting pixels on the pupil plane by the respective micro-lenses 4a overlap one another.
