A band-selecting apparatus for peer-to-peer communications in a broad band wireless communications system without interference in a cellular system and a method thereof are provided to perform peer-to-peer communications without interference in a cellular system by determining a band for P2P. A first calculator(832) estimates maximum transmission power of a terminal by using channel information and capability information of the terminal. A second calculator(834) calculates preference of the terminal for each bandwidth by using interference information and interference information of the relative terminal and for each bandwidth maximum transmission power information. A decider(836) determines the P2P transmission band of the terminal according to preference by each bandwidth.
