A method of determining a motion vector is provided to determine a list 1 reference picture indicated by the motion vector having a co-located block as a list 0 reference picture for the direct mode for improving the possibility of selecting the direct mode as a prediction mode of a macroblock. When a list 1 reference picture for a direct mode of a Bi-predictive picture is placed before or after the Bi-predictive picture temporally, a motion vector, contained by a co-located block placed in the list 1 reference picture of the direct mode and determined regardless of the list 0 and/or list 1 modes, is scaled. The motion vector of the direct mode of the Bi-predictive picture is calculated by guiding a list 0 motion vector and a list 1 motion vector. The motion vector of the direct mode of the Bi-predictive picture is calculated by determining a reference picture indicating the motion vector as a list 0 reference picture for the direct mode.
