PROBLEM TO BE SOLVED: To suppress the deterioration of encoding efficiency by appropriately setting an IDR (instantaneous decoding refresh) picture.

SOLUTION: This moving picture encoding device for performing a motion reference in a pixel block unit constituting image frames between a plurality of image frames to perform compressive encoding is provided with a reference frame prescribing means for prescribing a prescribed frame as a reference frame among the plurality of image frames, an information generating means for generating reference information about the existence/absence of a third image frame having a pixel block subjected to compressive encoding with motion reference to a second image frame among first image frames which are subjected to compressive encoding after the reference frame and can be subjected to the motion reference about at least the reference frame and the second image frame encoded before the reference frame, and a setting means for setting the reference frame in a reference limitation frame for compressive encoding with the motion reference to the second image frame on the basis of the reference information.
