PROBLEM TO BE SOLVED: To enable an optical element, which reflects and transmits linear polarized light according to its vibrating direction, to extract one of two linear polarized light components having mutually orthogonal planes of vibrations from both reflected light and transmitted light on one side of the element and to optionally adjust the ratio of the quantities of the reflected light and transmitted light. SOLUTION: The linear polarized light extracting optical element 10 is constituted by forming a birefringent layer 14 by stacking >=3 layers of birefringent films on a light-transmissive substrate 12, and reflects one of the linear polarized light components having mutually orthogonal planes of vibration and transmits the other; and the number of the stacked layer is made less than the number needed to reflects one linear polarized light component with maximum reflectivity. Consequently, one linear polarized light component is reflected with reflectivity less than the maximum reflectivity while the rest is transmitted, and the other linear polarized component is transmitted.
