PROBLEM TO BE SOLVED: To provide an electrophotographic photoreceptor having high surface hardness, high wear and scuffing resistances and retaining stable electrophotographic characteristics even at high temperature and high humidity in repetitive use because it has a surface layer as a coating film having considerably improved homogeneity and precision to uniform film thickness and to provide a process cartridge with the photoreceptor and an image forming device. SOLUTION: Relating to the electrophotographic photoreceptor having at least a photosensitive layer and a surface layer on an electrically conductive substrate, the surface layer contains a curable siloxane resin containing a structural unit having electric charge transferring performance and is formed by coating with a vertical coating type apparatus. Relating to the electrophotographic photoreceptor that at least a photosensitive layer, an adhesive layer and a surface layer are formed in this order on an electrically conductive substrate, the surface layer contains a curable siloxane resin containing a structural unit having electric charge transferring performance and the adhesive layer contains a resin composition and is formed by coating with a vertical coating type apparatus.
