PURPOSE: A control device of a work mode of construction machinery according to an axle oil temperature is provided to detect a temperature of axle oil, and to change a current traveling speed to a lower speed when a current axle oil temperature reaches a predetermined temperature, thereby facilitating safety operations. CONSTITUTION: A control device of a work mode of construction machinery according to an axle oil temperature comprises a detection unit which detects a temperature of axle oil and outputs the temperature value; an electronic control unit (ECU) which controls an engine to output a predetermined power set in a selected work mode among a plurality of work modes; and a vehicle control unit (VCU) which controls a hydraulic pump corresponding to the selected work mode and the ECU together. If a weight value detected by the detection unit is greater than a predetermined weight value and the selected work mode is an upper level work mode requiring output ascension of the engine and the hydraulic pump, the control device of a work mode for construction machinery controls the ECU and the hydraulic pump to operate at a lower level work mode. If the weight value is reduced, the control device of a work mode for construction machinery controls the ECU and the hydraulic pump to return to a predetermined work mode.
