PROBLEM TO BE SOLVED: To provide a system and a method of packetizing data streams in a P2P based streaming service.

SOLUTION: A packetizing system related to one embodiment of the present invention is for indexing a data stream received from an encoder to pieces, and includes a piece generation unit for generating the pieces for the received data stream at every preset time interval. The piece generation unit may generate an empty piece in a time interval during which the data stream is not received.
