PROBLEM TO BE SOLVED: To provide a photographing device and a photographing method capable of keeping both relations between a face and a light source and between the photographing device and the light source at constant. SOLUTION: The photographing device 1 includes: a face angle detection section 101; a photographing device angle detection section 102; and a photographing chance detection section 103. The face angle detection section 101 detects an angle of the face of an object relative to the photographing device 1. The photographing device angle detection section 102 detects an angle of the photographing device 1 relative to the gravity direction. The photographing chance detection section 103 detects a photographing chance based on the angle of the face which is detected by the face angle detection section 101, and the angle of the photographing device 1 which is detected by the photographing device angle detection section 102.
