An apparatus operative to identify a data rate for receiving packet data via at least one of a first set of channels in a wireless communications system, the system supporting packet data transmissions and low delay data transmissions over a plurality of transmission channels, the apparatus comprising means for receiving a pilot signal, means for receiving an indicator of a transmission power separate from the reception of the pilot signal, and means for identifying the data rate for receiving the packet data using information derived from the pilot, signal and the transmission power.
