PROBLEM TO BE SOLVED: To provide a control device of an internal combustion engine, highly accurately determining a combustion state, in the control device of the internal combustion engine. SOLUTION: A system identifying part 10 is composed of a data clustering part 12, a separate hyperplane estimating part 14 and a system parameter estimating part 16. The data clustering part 12 classifies the past data on the air-fuel ratio, the EGR ratio and a crank angle speed into a combustion stable cluster and a combustion unstable cluster. The separate hyperplane estimating part 14 specifies a boundary condition between a combustion stable state and an unstable state by these past data. The system parameter estimating part 16 specifies an ARX model realized between these data in the predetermined time and the crank angle speed in the time before by one step more than the time.
