PROBLEM TO BE SOLVED: To provide an operator discriminating device capable of discriminating whether an operator for operating an in-vehicle device is a driver or a passenger. SOLUTION: The operator discriminating device 3 comprises an arm rest 13 having a pattern 130, a near infrared ray camera 31 provided so that the pattern 130 can be image-picked up via an arm of an operator, an image 300 picked up by the near infrared ray camera 31, and an image processing unit 32 having a detection unit 32a for detecting a basic pattern 131 based on the basic pattern 131 constituting the pattern 130, a binarization unit 32b for preparing a binary image 301 through the binarization based on the detection or non-detection of the pattern 130, and a discriminating unit 32c which extracts first and second connection components 20a, 20b by performing labeling based on the binary image 301, and discriminates whether or not the operator is a driver 2A or a passenger 2B based on the position of the center of gravity of the first and second connection components 20a, 20b.
